ActionsPlan on implementation of Hague Convention 1965 ratified
(Bqp.vn) - The PM has approved the plan to implement the Hague Convention on the Service Abroad of Judicial and Extrajudicial Documents in Civil or Commercial Matters 1965.
The plan is aimed at taking full advantages and fulfilling responsibilities as a member country of the Convention, improving the capacity and effectiveness of the nation’s service abroad of judicial and extrajudicial documents and facilitating the completion of the domestic legal system in civil matters based on the international standard.
The plan sets measures such as communication, training and raising the awareness of the Convention, upgrading the capacity for the staff group in charge of realizing the Convention and preparing suitable financial resources to ensure the full realization of rights and tasks of a member of the Convention.
The Hague Convention of 15 November 1965 on the Service Abroad of Judicial and Extrajudicial Documents in Civil or Commercial Matters provides for the channels of transmission to be used when a judicial or extrajudicial document has to be transmitted from one Contracting State to the Convention to another Contracting State for the service in the latter. As many as 71 developed and developing economies have joined the Convention.
It also aims to establish a system which, to extent possible, brings actual notice of the document to be served to the recipient in sufficient time to enable him to defend himself. Furthermore, the Convention facilitates proof that the service has been affected abroad, by mean of certificates contained in a uniform model.
